The 4th amendment of the U.S. Constitution protects you from unreasonable searches and seizures. Unfortunately, when you’re pulled over on the side of the road or sitting in your living room as the door is broken down, the Constitution isn’t there to stop the police from violating your rights or protect you and your belongings from harm. This is why federal law was created to offer a remedy for these situations after they occur.
It’s not uncommon for police to search the wrong house, or to become overzealous during a legal search and damage a person’s belongings. When this happens, it’s very difficult to do anything about it because it was the police who did the damage. Often, people are too afraid of the police to do anything about it, and the police count on this fear.
